Caprock Pumi Pet Puppy Contract

This contract is between Jennifer Harper herein referred to as “Seller”
and________________________________________________, herein referred to as “Buyer”. The Seller hereby
conveys unto the Buyer the below described dog under the following terms,conditions, and warranties as
agreed upon herein.
DESCRIPTION OF DOG
The dog herein conveyed is an AKC registered Pumi. The particular dog, hereinafter referred to as the Puppy, its
registration, date of birth, lineage, etc. is more fully described in packet sent home with Buyer.
LIMITATIONS OF CONTRACT
This contract applies to the original puppy and original buyer only and is non-transferable to a second party.
SELLER’S REPRESENTATIONS
As of the date of this agreement, the Puppy is in good health and is free of communicable diseases. Although every
precaution has been taken to transfer a healthy puppy, Seller will not be responsible for any illness or health problems
which are diagnosed after Buyer’s initial veterinary health check, which must occur within 72 hours of date of sale.
Should the Puppy be found in ill health, the cause of which is clearly attributable to Seller (Seller must be informed
within 48 hours of veterinary examination), the Puppy may, upon presentation of a written diagnosis from said
veterinarian and a veterinarian of the Seller’s choosing be returned for a replacement or refund. If Buyer chooses to
keep the Puppy after such diagnosis, Seller will refund to Buyer one-half of the purchase price. The Puppy is PET
QUALITY.
CONSIDERATION
In consideration of the terms and conditions stated herein and the sum of $2,500.00. The Puppy is being sold to
Buyer. A deposit of $200.00 may be applied to the purchase of the Puppy, which is non-refundable. If no PET
QUALITY puppies are available, the deposit will be applied to the next Caprock Pumi litter.
SPAY/NEUTER AGREEMENT
Buyer agrees to have the puppy spayed/neutered by the time the puppy is no more than seven months old. It is the
Seller’s belief that since the puppy is not show quality, it should not be bred. The puppy will be sold on Limited
Registration with the AKC with the understanding that any offspring produced will not be eligible for registration through
the AKC. This makes the puppy ineligible for competition in Conformation, but the puppy is still eligible for all other
fields of competition offered by the AKC.
HEALTH
Seller guarantees that the Puppy has received appropriate medical inoculations and care including Parvo inoculations
and wormings. Seller will provide buyer with a medical chart detailing treatment the Puppy had received under Seller’s
care and future care Seller feels is essential to Puppy’s well being. Seller guarantees that the Puppy will be free of the
following genetic defects for 26 months from birth: Hip Dysplasia, Primary Lens Luxation, and Degenerative
Myelopathy. Both parents of the puppy have been tested for these defects and have been found normal. If before 26
months of age the Puppy is diagnosed by a veterinarian specialist for any genetic defects for the Puppy’s heart and/or
eyes, the Buyer has the right to return the Puppy for a full refund or the Buyer may keep the Puppy and receive half of
the purchase price back to aid in any veterinary costs that may occur. Seller reserves the right to have the Puppy
examined by a 2nd veterinarian specialist to confirm the diagnosis.
TEMPERAMENT
Seller strongly recommends that Buyer enroll the Puppy in obedience classes and provide proper socialization for the
Puppy.
MAINTENANCE
Buyer agrees to maintain the Puppy in good health, provide routine preventative health care including, but not limited
to, the following: Annual physical exams by a licensed veterinarian, Rabies inoculations as mandated by state law,
Continual heartworm preventative, Control of flea, ticks and other pests, Annual DHLP-Parvo, including mid year Parvo
boosters, Puppy will be kept clean physically and in a clean environment-Buyer further agrees to provide proper
exercise for the Puppy in order to maintain the Puppy in proper weight and physical shape. A proper diet consisting of
a premium quality dog food shall be fed. WE RECOMMEND PURINA PRO PLAN SENSITIVE SKIN. Buyer agrees that
puppy is not to be left solely in backyard or kennel or crate and will be allowed to spend time in home with family
members. The Puppy is sold with the understanding that it was to go to carefully selected parties, and that the Buyer
agrees that the puppy shall be a member of the family. Buyer further agrees that the Puppy will NEVER be tied out,
chained, or otherwise confined in a manner that is potentially injurious. The Puppy will be confined to a fenced yard
and never allowed to run free unless it occurs during training. Buyer will not leave the Puppy outside in any inclement
weather including, but not limited to, rain, hail, freezing temperatures, or extreme heat. Buyer will ensure that the Puppy
has access to fresh, clean water at all times. -Buyer must NOT at ANY time transport the Puppy in the open cargo area
of a vehicle, such as the bed of a pick-up truck. A crate in the interior of a vehicle is always the safest mode or
transportation.
MISCELLANEOUS
During the life of the Puppy, Buyer agrees to notify Seller within 30 days, of any change of address or phone numbers.
Seller would appreciate receiving annual photos and news of the Puppy with the family. -Buyer agrees to inform Seller
of any titles or awards obtained by the Puppy over the course of it’s lifetime for Seller’s breeding records. Buyer affirms
that he/she/they are not acting as an agent in the purchase of the Puppy and are not associated with a pet shop,
animal broker, auction, raffle, scientific research lab, wholesale establishment, chain store, commercial enterprise,
rescue organization, puppy mill, or donated to a charitable organization and that the Puppy will remain solely in the
custody of Buyer. If it is reported and confirmed that the Puppy is being abused or neglected by Buyer in contradiction
of this agreement, rights and ownership of the Puppy will automatically be terminated and ownership of the Puppy will
revert back to Seller who may immediately assume possession. All costs incurred by this action will be paid for by
Buyer.
RIGHT OF FIRST REFUSAL
If at any time circumstances are such that Buyer cannot keep the Puppy, Seller maintains “Right of First Refusal” to
monies recovered from the re-sale of the Puppy MAY be given to Buyer at Seller’s discretion. The term “Right of First
Refusal” means: if the Buyer chooses to relinquish ownership of the Puppy, the Puppy shall automatically return to
Seller or Seller’s designee. Under NO circumstances shall the Puppy be taken to an animal shelter, humane society,
research lab facility, animal broker, pet store, etc.
DEFAULT
If Buyer breaks any of the covenants of this agreement, ownership of the Puppy reverts to Seller at the Buyer’s
expense. Buyer agrees that Seller shall have the right to enforce provisions of this contract in a court of law or through
alternate dispute resolution. All legal costs incurred by such process are the responsibility of the Buyer. Buyer agrees
if any of the above terms are disregarded, Seller will resume ownership with no monies refunded.

Any notice to be given under the terms of this agreement shall be to the following:

ACCEPTANCE
By signing below, Buyer (s) and Seller both acknowledge that they have read and understand their respective rights
and obligations and are legally bound by all the provisions of this agreement. This agreement shall be enforceable
under the laws of the State of Texas and venue is hereby established in Montgomery County, Texas.
